STOP AL ZAHRA REAL ESTATE

Just when the sheik of Dubai is trying his best to make Dubai real estate marked as bountiful and straight as possible, there are unfortunately smelly fish in the water!
Al Zahra Real Estate is apparently one of them.

Even by looking at their website one can tell that there is something fishy there.
The latest news on their website were added on 21 July 2007, so more than a year ago.
The 4 projects on their website that flashes in your eyes are:
1. Eden Blue (which has nothing to do with Al Zahra as far as I am informed).
2. Sunrise Gardens, not existent if you enter this site, you get transferred to Sunset Gardens.
3. Eden Residence, non existent!
4. Sunset Gardens, well this is the whole reason for this website!
What is going on with Sunset Gardens B? Nothing except Al Zahra has taken the investors money, and this is apperently where the story ends. Or does it?
Companies like Al Zahra Real Estate and Aspire give Dubai a bad name, investors will move out of Dubai and invest in more safe places. The media in Europe are just waiting for a scandal in Dubai after all the happy stories of being the best in the world and the crime free environment. Well maybe it is not so crime free after all.

I just saw your comments on the developer. I am actually an investor too. The developer is one of the worst and unprofessional company's I have ever dealt with. I am not quite sure where do we stand with the project and the same time, there seems to be no one to stop them. The project was suppose to finish on December 2008 and to date they still have not started the project.
All I can say is WE NEED TO DO SOEMTHING. I AM GOING TO CONTACT RERA TODAY INFACT as this subject is giving me the high the bloodpressure.

RERA served a writ on my behalf 2 weeks ago to Al Zahra proerties - re Sunset Gardens B and a seperate independent legal writ was served last week. I am still waiting to hear of the outcome. I have previously complained in writing to RERA 4 times and have visited them twice in person. They should in my opinion acted much faster than they have. This project and the 7 others will never come to fruition. It is a travesty that this company have been able to trade as long as they have, taking more and more money from honest investors with absolutely no commitment whatsover to any of the suopposed 'projects'.I spoke recently with the CEO of DIAR Consultancy who did all the prelim'designs. He has never been paid and is now suing them. I would urge all concerned with Al Zahra to strongly make the case known at RERA and, where possible, take a half day, go to the third floor and insist on speaking to the Chief, or M/Khawla Madani, do not be fobbed off. The legal route is THE only recourse. I have visited the AlZahra office 7 times this year. Each time I see the idiot Customer Services Mgr 'Veebesh'who is just there as a prop and repeats the same old diatribe - much as his predecessors did.

I don't think al zahra real estate will delever the any project i find out they don't even own the land and rera and the land department knows that but my question is why the goverment of dubai don't do any thing about this?some one could unswer me

I think any one who have purchase a property from al zahra properties should go to Bur Dubai police station and ask for Mr Sultan Al Hamadi and open a case against them. This is what i have done. His number is 0097143107589
My name is Mohamed my contact number is 0044 7790984956.
Fell free to contact me or exchange information.I'm a victim too of al zahra properties scam.

hello all is there any update from rera regarding the legal notices served earlier this month?

surely rera are to blame as well for approving sunset gardens on their website which we use as comfort for investing in this project.

Hi every one the latest news i have got is youcef al meki done a runner i just spoke with bur dubai police station this morning and they are looking for him once they get him they will contact every one who open a case against him so i think best way is to expose them to the world by going to the news and tell what happen.

Anonymous said...

mohamed, thanks for your update but what has the police got to do with yucef al makki? i very much doubt that bur dubai police will get in touch with investors. Although it's good to have an update from the cops we should be focussing on news from RERA/Dubai land...

Hi. You can also follow the thread http://www.skyscrapercity.com/showthread.php?t=569875
where there also are a lot of dissatisfied investors.
Thank you Mohamed and every one else for your info, I too am an investor.
If the newspapers in Europe hear of this they will love it, they are waiting for a scandal from Dubai, just look at the story with the sewage in the sea of Dubai, the newspapers in Europe wrote so much about this problem, and they exaggerated and made it a lot worse than it was.
From Rene

Anonymous- I would like to know if any of the dissatisfied investors know who is the real head of Al Zahra Real Estate. We too are suffering from a similar scam and have a feeling that it is the same company under a different name. Whoever knows of the main contact person in Al Zahra, please share- thank you!

Hi,

I am an investor in Sunset Gardens B and since I have found this blog have become very nervous. Maybe I am naive, but I thought the whole point of the "Trust Accounts" (Escro) was to protect investors from abuse. I understood that funds had to be released by the DLD. Is this not the case, or has someone got information that the moeny has been released?

I would appreciate any advice.

Hi every one i just spoke to my lawyer this morning and he said that he heard the news in dubai radio saying that lot of developer left the contry and that does not sound as a good news i think we should all tell the news about this and expose them to all europe because in first place its the fault of dubai govermant to blame on this they did not have any control regarding this situation and some people took the adventage of this mess to scam others like us

Hi there, my wife and i are also investors with al zahra and after making 2 payments stopped paying as we recieved no reciepts or other communication, we then went out last year and found that our money was split over 3 companies-luxury city, aspire, and al zahra and we then found out that none of them had the land or permission to build!!
so far we have recovered some funds from Aspire & luxury city but nothing from al zahra {we achieved this by staging "sit-ins"in each office, ran out of time for al zahra hence this next trip. will let you all know what happens-good luck to you all

UPDATE!!!
my wife is just off the phone to me, she is currently sitting in the office of al zahra{which is obviously open} 3 staff on duty, no phones or AC on, she says that there have been a string of people into the office today seeking payment for unpaid bills and investors such as ourselves.{she speaks urdu and punjabi and has been eavesdropping}
Abdul Azziz has shown her a file filled with unpaid invoices and demands for payment, she thinks that the office while open at the moment,it will not be open for much longer.
she is staying in the office to see if anyone of authority comes in, as all those there are just staff and are giving her the usual BS!!, money being unfrozen soon, building starting soon, delays not our fault etc, etc.
If you have anyway of salvaging anything I would suggest you do it ASAP! before the doors are closed!!!!!!

i have invested on sunset gardens also, i paid %45 of the total and now i can't reach them, one of my friend in Dubai went to their office and the office is closed, nobody there, 2 weeks' newspapers are on the floor so it is not closed for that day only... and he learned that they are gone without paying the bills, etc...
how will we going to get our money back? does somebody know what we can do?

Hello brothers,

I have puchased from Al Zahra as well but in Jeehan 1, I have paid cash unfortunatly and there was no escrow account at that time, we need to do something all together, as this is something not acceptable, at all in any country, plus the 1rst one who should be arrested is their represntative R..bbesh the biggest liar and I couldn't understand how much they are paying him to work for them...
It seems no body in Rera willing to help I have sent them 10 e-mails with no response from them, even i went and met with few people there and they told me not to worry just be patient,...for how long i don't know it s been more than 48 month so far, maybe i suggest that all we meet, all the investors and we arrange to meet with his highness Sheikh Mohamed, we need to try anything to get our money back, i know also some investors who willing to do what i have mentioned so will be waiting your reply

I've just found this site and have read your posts with great interest. I am also an investor in the Jehaan 1 project (Reserved through Luxury City, first contract issued by Aspire, then further payments and new contract through Al Zahra). I visited Al Zahra in March requested a refund as they had not fulfilled their side of the contract to build etc. Got same story - accounts frozen, no money available. They offered me and numerous other visitors at the office all with same problems an alternative project. Personally I have no interest in continuing dealing with them and want my money back! I have a letter of agreement and they are supposed to be refunding me in the next couple of weeks - I don't see this happening. Vibesh and Akmel (?) financial guy, were who I saw. The stream of people to the office was incredible - all with the same problems.

I understand Al Zahra has now moved their offices down to Barsha - only mobile phones now being used and these never answered.

I am currently in the UK - does anyone have any update on this company. According to another website Al Zahra does not own the land for Jehaan 1 to be built - Aspire now seem to be moving forward on the other buildings in the Jehaan project - a bit galling that Al Zahra purchasers are now out on a limb.

I have seen that all investors are just talking as most of them are just waiting for others to take actions. Most of them dont want to work hard to get their money they feel when others who r working hard for their money get theirs, eventually all will get.
I WISH EVERYONE UNDERSTANDS THAT AL ZAHRA WONT COME TO UR DOOR AND PAY U, SO PLS WORK HARD AND FOR GODSAKE UNITE AND HANDLE THIS CRISIS.

Dear All
I went to RERA last week and they have stated (Chap on the 2nd floor room 12) that the owner is in jail.

Does any body knows what is the actual name of the company, have a copy of their registration/licence, is it a limited company, who is the owner and who is the autherised signature?

please update me at abujamil@hotmail.com

I also went to Dubai Court, they said I need to translate all the documentation, and pay AED 30,000 for each unit if I want to bring a case against Al Zahra (I have two, one bedrooms, these fees are court fees and there will be the Layers fees if appointed.

It seems to me that this is a money making machine and it must be handelled by a lawyer.

Please advise if any legal action has been initiated and whom do I have to contact for more information.

I think the system is meant to frustrate and intimidate people so that no-one is willing to file a lawsuit as the costs are high and considered to be an extra loss.!
So, my suggestion, is that if each victim (owner or investor) puts a 1000 DHS , we can afford to file a law suit ( be it class action or as individuals having exactly similar case). The court should then order the release of the money from the Escrow account ! Does anyone know what is the status of that escrow account and how much money is there ?

Sukigirl said...

Anonymous, you don't say which project you have bought in with Al Zahra. If its Jehaan I - there is no escrow account hence the problems many people are encountering.

(As so many posts are using anonymous it is difficult to know it its the same person or many different people)

Hi all
I approached RERA. Hahaha! Yes, good old RERA. I then got my wife to throw a fake tantrum in the CEOs office, as I heard that an Iranian investor from Holland did so a few weeks back, and stormed into the RERA chief's office. RERA apparently called Al Zahra on the spot, and got them to appear in the office. The Iranian got his money back. When we tried to duplicate the tantrum act however, the chief was overseas, so the secretary tried to placate by offering to take my case up personally with the chief. Surprise, surprise, the message to us the next morning is that we should take Al Zahra to court. So I started scheming about gambling Dhs 30,000 on a lawsuit, mindful that I am unemployed and that Al Zahra may have no money to actually pay me if I won anyway. A week later, I spoke to someone who used to work in Al Zahra, and she advised me to go the cops and file a charge of fraud immediately. Well, I went down to a translation shop and got my docs translated for a couple of hundred bucks, and went off to the cop shop. I was told to return in the morning at 7:30. So tomorrow I'm off to lay my criminal charge against them. I say forget the civil lawsuits - rather go for a criminal charge. It may have more pursuasion. As a matter of interest, about three weeks ago, Makki's wife, Alia, actually told my wife to feel free to take them to court. Al Zahra is now trying to palm shops from International City off on us. As at about 5 days ago, it was reported that Alia was in London.I do not know if she has gone on a short trip or permanently. As I say, we spoke to her on her Dubai mobile 3 weeks ago when she was still in Dxb. Anyway, wish me luck. Will let you know what happens.

i hear that alzahra actually startin construction on projects is this true for sunset gardens?

Anonymous said...

No Al Zahra will never start building. Do not believe a word of what they are saying.
They even claim that a costructor called Fairy will start building Sunset Gdns B, but guess what there are no records for Fairy, no trade licence - nothing.
Our only hope is that Rera will cancel all projects by Al Zahra, we should all put pressure on RERA to do so, then we can get back the money we paid into the Escrow account, better than nothing.
If we don't do this, Al Zahra will make false invoices from Fairy construction and try and get our money released to them from the Escrow account.

hello
i am from the UK. i bought in 2 appartments in jehaan 1. i have given al zahra 30,000GBP in total for nothing in return. i am now wanting the money back as nothing has ever been built. my friends also bought appartments in jehann. between us all we have invested around £150,000GBP.
i went to dubai in feb 2009 and al zahra were offering us an appartment in discovery gardens but this was a poor option. i just want ALL my money back ASAP.

i have emailed al zahra several times and they dont reply to them. i remember the last time i was in their office mr vibeesh used the excuse that their server was down. i have tried ringing their office but i cannot get through. personally i dont believe mr vibeesh or al zahra says.
can anyone help me and my friends get our hard earned halaal money back from these theives?

does anyone have any news regarding this rogue company?
has anyone recieved any money for their investment which never materialised.

Hello All, with reference to my post dated 7 Dec 2009:

I laid the criminal complaint against Al Makki and my case is with the Public Prosector's Office in Dubai. The cop at Bur Dubai police station showed me the cases against Al Makki, and I counted more than 16 cases on his PC monitor. He confirmed that it is actually more than 16 cases. He also confirmed that Al Makki is in Central Prison, and has been for some time. I now have to wait my turn, as the cops are taking al Makki's statement for each and every case. So far, it has been more than two months since I laid my fraud charge, and I expect to receive a court date within about another two months time. I am sorry to say this, but my humble opinion is that you will not see your money again - no matter how many cases - civil or criminal - you lay against him. RERA will not really do anything for you either - I know, as I have tried. I will now wait to see what al Makki's offer (if any) will be when I hopefully see him in court. My case concerns a shop, not an apartment. In addition, forget about this Vibesh character and writing letters etc - it is way beyond that now. It is now down to you and Al Makki. I doubt he even has the money to refund to you. I am just writing it off as a bad experience. Yes, yes, I know it sucks...Good luck.

hi all
this is bad news for all of us. i have made 2 payments into an escrow account for an appartment in jehaan 1. does this mean i will not get this money back? i thought an escrow account was a government account and was set up to protect the customer from fraud.
what i dont understand in a country where it is illegal to kiss in public ( the latest media hype) and a criminal offence when a cheque bounces....how can this go on??
it sounds to me like dubai just like the rest of the arab states are just led by a bunch of western ass licking hypocrites!!!!

Anonymous said...

There is NO escrow account for Jehaan 1. The details about an account with Standard Chartered Bank which was issued at the beginning was a normal current account NOT an escrow account. The money paid for the Jehaan 1 project has been misappropriated by Al Zahra and its management. Unless there is intervention by a third party it does indeed look as though all investors in Jehaan 1 have now lost their money. I would also guess that the sunset apartments project is also headed the same way.

Anonymous said...

hi all
this is just getting from bad to worse. let me get this straight......the 1st payment i made was to emirates bank for jehaan 1 when i purchased the apartments. then luxury city instructed me to pay into an escrow account ie standard chartered bank and i made 2 further payments into this account. now u are telling me that is not an escrow account!!!! what the fuck is going on here??? i am sorry for the language but im losing it with these guys. how can u be sure this was not an escrow account? even that lying bastard vibesh said that payments had been made to an escrow account and we would have contact the government office to release these funds.
i will include the email i recieved from luxury city below. this means luxury city would have had knowledge that this was not an escrow account!!! are they involved? this sounds more unbelievable. here is that email:

We write to advise you of the latest development of the UAE Property Law whereby effective 31 December 2007, it is mandatory for all UAE Developers to have an ESCROW Account for each and every Dubai project.

Luxury City Real Estate welcomes this development as an initiative that shall protect the rights of all Dubai property investors. In effect from January 2008 all payments made towards property purchases shall be deposited into government controlled ESCROW accounts. Therefore the government of Dubai will guarantee your funds and all projects will remain safe and secure. Furthermore should any developer default, the Dubai Government shall either continue with completing the development or refund monies.

The Dubai Government also requires that 5% of the Project value shall remain in the ESCROW account for a period of 12 months in order to cover snags/defect issues that could arise. All in all this is a sound development to protect the best interest of Dubai property investors, the Dubai property industry and Dubai’s property market in general.

In accordance with these new Government laws and regulations, Luxury City Real Estate shall be closing its client accounts on the 31st of October 2007.

If you have purchased property through Luxury City Real Estate recently, in the next few days, we will send you a letter from your developer stating their compliance and the bank details of the project you have invested in. Please note all future payments must be made directly to this account.

Should you have any further queries, please do not hesitate to contact me on the details below or our office directly.

Yours sincerely

surely something can be done to recover our money. al makki must have assets in the country which we can seize and sell to recover our money. what about luxury city?
has anyone gone after them? me and my friends who invested in jehaan 1 havnt even been to dubai since feb 2009 let alone goto the police station or file a case against him.
i suppose the only consolation is that al makki is behind bars.....i hope he gets raped everyday. he certainly would if he was in the UK!!

hi all
these are worrying times. the more i read these latest developments it makes my blood boil.
is al zahra's office still open behind the emirates mall?
i would love to pay them a visit soon. will it achieve anything?
does anyone know if we paid into an escrow account?
surely there must be someone out there who can help us all and give us some answers.

Anonymous said...

Fearless - if you do decide to pay them a visit, please let the rest of us know where they have moved too!!

The account where funds were paid into for Jehaan 1 was NOT an Escrow account. This was confirmed in previous posts/forums by someone who went to Standard Chartered Bank and asked them to confirm the status of the account. Please check with the bank yourselves - I would love to be proved wrong on this.

hi
im in the uk so i wont be going anytime very soon. if i get time off work i will certainly go to dubai to see my fat lying friend vibesh!!
i thought their offices had moved from sheik zaid road to behind the emirates mall? is this not true?
i will have to look into this escrow account at standard chartered bank when i go.
when i went in feb 2009 vibesh was trying to sell me a replacement apartment in discovery gardens. he said if i could get the money i paid released from the escrow account i could pay the difference and buy in discovery gardens.
so is this bullshit aswell? were they trying to get more money out of us??
im sick to the stomach with all this bullshit!!
we need to all unite and fight this. we need to appoint one person as leader who is a resident of dubai to get to the bottom of this. i am sure we would all pay a share of the money recovered to this person if we won for their hard work.
what do you all say?

Anonymous said...

Fearless,
Al Zahra have left the offices behind the Mall of The Emirates. They went without leaving any forwarding address or contact numbers. All the mobile phones are now switched off.

The Discovery Gardens deal never happened - no-one (to my knowledge) ever moved projects - this was another stalling tactic from Al Zahra.

Good luck with the bank - I am sure we would all be interested in what you find out.

salaam
this blog has gone very quiet?! there could be two reasons for that
1. nobody gives a shit anymore...they have resigned to the fact they have lost all their money invested with al zahra and they will never see it again.
2. everyone has had their money returned to them and they are busy spending it!!
i bet its the first reason!!!!
what is happening here????/
does anyone know what is going on???
i am going to dubai on the 18th june 2010 for a week. i am going to try to get some answers.
does anyone know where al zahra offices are? that is if they have offices!! who can we contact?
i am proposing to go to RERA followed by a visit to the police station to file a case against al zahra. i am not sure if its worth visiting a lawyer to discuss this matter. my friends and myself have invested over 150000GBpounds with these crooks. we want it back!!!
is there anything anyone can suggest we do while we are out there?

Hi all its fearless…………………again!
I went to Dubai on 18/6/10 and stayed there for 5 days. I went with the sole intention of attempting to get answers in relation to our investments with al Zahra. I and a fellow investor investigated all leads while we were there.
These are our findings:
1. I can confirm there was never an escrow account for al Zahra properties. We went to standard chartered bank on al mankhool road where we paid our money to al Zahra; they confirmed it was a business account. Soon as our money hit that account al Zahra were free to withdraw unregulated. The account was still active but we could not establish whether there was any money in the account. I assume there will be no more than a couple of dirham’s in the account!
2. We went to RERA. They were lost as usual. They did confirm all projects by al Zahra had been cancelled. We assumed we were entitled to our money if RERA had cancelled the projects but they said we need to file a case with the law courts to retrieve our money. I am happy to conclude that RERA did not disappoint us………they are useless as tits on a boar!
3. We went to bur Dubai police station. This is the only place you can go to if you want to file a criminal case against Mr. al makki. The policeman told us to translate all our documents into Arabic with a letter of events leading to the fraud and deception. They would then log the case. We then had to a place where they translate documents into Arabic. We were told that we would need a legal translation and that would cost us 80 dirham’s per page and it would take 3-4 days. We did not have that much time. We decided against this. Even if we decided to go ahead with this the police can’t do anything. They will not be able retrieve the money for us. All that will happen is Mr. makki who is in jail already will have a few more criminal cases against him and he may have to spend more time in jail. That doesn’t really help us.
4. We then went to al Zahra previous known address Ramada hotel behind mall of the emirates. They had indeed left there. We got a mobile phone number from the reception for the developer. His name was Emad Shoukry Seif Elnasr. We decided to ring him. He returned our call telling us he is coming back from Egypt and he will see us in the morning.
5. We went to see Emad. We were instructed to meet him on al khail road gate number 10 jumeriah village circle. He sent a driver to pick us up. He took us to the development site for sunset B. we saw the boards around the site with al Zahra logo on them. There was a lot of construction taking place around the area; however, all I saw of sunset B was 4 rectangular 5 inch concrete slabs on the sand and 1 cabin where al Zahra properties now conducted all their business. The slabs of concrete on the sand indicated where the blocks of apartment would stand. There were no work men on site nor were there any tools or building materials.

Anonymous said...

6. We spoke to emad and he assured us we could transfer our apartments from jehaan 1 to sunset B. they pulled up our files from computer and told us this would not be a problem. Emad was an independent contractor to build sunset B. he was called by Mr. al makki’s father who was his friend and told to start building these apartments in order to get Mr. Makki out of prison. He told us he was not in any way or form part of al Zahra. He was there just to clean up the mess!
7. He told us sunset B had been cancelled by RERA but he had a meeting with RERA the day after to reverse the cancellation as they were now in a position to start building. He anticipated they would have sunset B finished in 14-16 months from now.
8. We left al Zahra offices confused not entirely believing all we have heard.
9. We decided to meet up with a lawyer. He was familiar with Mr. al makki and had met him once in court. He told us he could take luxury city and al Zahra to the property court of Dubai and fight our case. He told us it costs 30,000 dirham’s per apartment to file a case in the property court. This is a standard fee. He would charge us 10% of the recovery fee. 5% payable up front and 5% in three months. There were other charges aswel but were small in comparison. He told us even if we won we may not get ant money back. All he could do then is to black list Mr. al makki and get him sent back to prison. So this was a poor option.
10. We then decided to visit luxury city real estate as we had receipts with them. We met up with their legal advisor. They told us they were simply brokers. They got their commission and passed on all our money to al Zahra. They were free of blame in any way or form. We did give him a hard time but we realized this was dead end.
11. It seemed to us we were between a rock and a hard place. We would have to negotiate with al Zahra who don’t have a good track record and are economical with the truth.
12. We spoke to emad and arranged to meet him at the airport as we were leaving that night at 11pm. We were surprised to get a phone call at 10pm from emad to tell us he is at the airport waiting for us.
13. Once again he confirmed he was the man for the job. He stressed he would complete sunset B in no later than 16 months and we could transfer from jehaan 1to sunset B. He was an independent contractor not affiliated with al Zahra; however, he remains the only contact for al Zahra. We told him we would not pay ant further installments until the building goes up in relation to what we have paid. He gave us his email address: emad_seifelnasr@hotmail.com his mobile number is +971 50 33 72 418
14. I have emailed him 1 week ago for new reservation agreements like he promised us but to this day I have had no reply. I am not going to hold my breath!!!!

I hope all this information was useful. I have returned to the UK. I understand many are in the same boat. After watching homes form hell on ITV2 regarding the problems in Dubai I have realized the scale of the problem. We must act and work together if we are going to see this through. A constant stream of updated information on this blog will help all of us.

Further to my post of 7 Dec 2009: I laid the fraud case against Al Makki 7 months ago at the police station. Still waiting...Rumour has it that he has been sentenced to 19 years in prison. Good riddance if it is true. Anyway, I've written off my money. Screw it - I'm moving on. PS: those of you who want to translate documents: don't pay thousands to lawyers - just go to one of the business centres in Shk Zayed Rd and you can have it done for 1 - 2000 Dhs - way cheaper.

Here's the numbers from Sunset B
we'll get back 10% on our money if we're lucky, the best option is for them to do the construction. And they still owe something like 15 million dirham on the plot.

I expect the project to be cancelled by RERA in December 2010, and I will apply for my money back then, - only the money I paid into the Escrow account which is basically 1/3 of my payment only.

We the investors have been warning RERA for several years now that the entire project is a fraud and unsafe.
If the director of RERA decides to release our money from the Escrow account to Mr. Maki presently in prison , then we must be able to hold the director of RERA personally resposible for our money. Right?

I think the system is designed to deter and intimidate people so that no one is going to sue the costs are high and looks like an additional loss.!

So my suggestion is that if all members of the victim (the owner or the investor) will bring in 1000 by DHS, we can afford to drop the lawsuit (which it is a class action or as individuals, are exactly the same case). The court must then for the release of money in an escrow account! Does anyone know what is the status of the escrow account and how much money do you have?

My advice to all of you, is don't waste your money on court fees and lawyers, as I already did for nothing, we need to plan for a meeting for all investors at anytime where everyone can travel and attend, to go to RERA and escalate the problem to all press and the public to see what is really happening in Dubai.
Please suggest a date and lets all confirm and make it happen, because there is no other solution, or forget your money

Hi, to who wrote the post on the 10th of May 2012, we agree with you 100%, we paid a lawyer for nothing as well.
This is whats making our cases useless, as each one of us is working independently and being ignored from RERA, while if we all arrange for a date at any time and we go to RERA and fight for our money, let the government or Sheikh pay us back. we cant all just sit here and expect them to pay us and we surely cannot all just lose our monies....This needs to be brought to the attention of all medias, surely someone cannot just steel and get away with it with no implications. someone has some money somewhere and can repay us.we know he is in jail but the family has money or the country... maybe its a 5 star jail for him with his connections.!! whoever is interested in getting together please send me ur emails so we can communicate altogether and find out how many we are or we can use whatsapp....my tel is 0096170249400... good luck.

The issues involving Legal Translation in Dubai has been a popular topic amongst scholars for many years. I find myself constantly drawn back to the subject of Legal Translation in Dubai. Indispensable to homosapians today, it is important to remember that ‘what goes up must come down.’ Inevitably feelings run deep amongst the upper echelons of progressive service sector organizations, who form the last great hope for our civilization. Here begins my in-depth analysis of the glorious subject of Legal Translation in Dubai.

They even claim that a costructor called Fairy will begin building Sunset Gdns B, yet think about what there are no records for Fairy, no exchange permit - nothing. Hi, I've just came back from Dubai, where I met my lawyer friend. The situation is tough as hell, as the most important thing I've learnt is that we've been cheated since the moment of purchase - Such a thing as Sunset Gardens B never existed and was never meant to exist. Have you noticed that they've been using different names (Sunset Gardens 2, Sunset Gardens B, Sunrise Gardens 2 etc.) for this project? Here is where the scum lies. This project never existed and we bought a virtual creation. The only thing we can do is to sue the Dubai gov for cheating and not having resolved it just in the beginning. Can you send me your contact details on szymon.kurzawa27@gmail.com? I'm trying to gather as many investors as possible to possibly start a joint legal action against them. My friend told me that the fact that this project was never meant to be is a bad news, but on the other hand we're probably the only group of investors who were cheated in this way, so here's our chance.

Best of luck,
Simon

H.H. Shaikh Mohammad Bin Rashid Al Maktoum, Vice President and Prime Minister of the UAE and Ruler of Dubai, has issued a new law amending the law on interim property registration in Dubai. source: Gulf NEws
(http://gulfnews.com/business/property/shaikh-mohammad-amends-dubai-property-registration-law-1.2122375)

According to the new law, if the project is cancelled by a resolution from Real Estate Regulatory Authority, the developer must refund all payments made by the buyer, pursuant to the law concerning Escrow Accounts for Real Estate Development in Dubai.

Apparently Férial Sabbagh is trying to refund the 10% of whatever was sent through escrow account and reach a settlement with the investors.

Please share the recent updates in here...

Anonymous said...

Thank you. The above information is really useful. Would this law apply to the Eden residence project as well

Anonymous said...

Have a meeting set up for Saturday. Will keep people posted on this page.

Anonymous said...

The Eden 2 is announced cancelled already and the case is going on for liquidation.

Dubai courts says;

"The next hearing will be on the 20th of December to submit the remaining documents of the cancelled projects of al Zahra real estate Company by the manger Mr. Yosef makki and to finish the settlement with the investors, kindly keep following us on rcp@dc.gov.ae for further updates."

I asked the details of an official contact at Al Zahra side but didn't get a reply so far. There must be someone representing them at the court. We need to talk with an authorized representative of the company.

I consulted to a lawyer friend of mine in Dubai and she says "you need to ignore it as there are some parties in Dubai who want to buyout cancelled projects at cheaper rates and then complete the project or claim the full amount from RERA subsequently."

Anonymous said...

Hi
This forum has come alive lately. This is all good and well but as victims of this fraud are we likely to get any money back?
Who is going to pay us and how do we get our money back? It has been almost 10 years since this fraud and I lost my money.

Thank you

Anonymous said...

First you should check if your project is announced cancelled by RERA. If so the case should be in Dubai Courts and you can get information by writing to rcp@dc.gov.ae

When the case is finalized the projects will be liquidated. We do not know the amount left in the escrow accounts but seems like the remaining amount will be refunded to the investors. I do not know if the investors should submit any documents to court during the case. So far nothing is requested from the courts. Also there is no official - authorized person from Al Zahra side who is reachable.

Sharing any information about the cases would be appreciated...

Anonymous said...

Hi

Everyone, please do not be FOOLED by this settlement agreement from Al Zahra, they want to get you out of the project so they can demonstrate to the court that there are no investors and sell the land back into the market or even relaunch the project as off plan projects are now selling.

They are asking investors to sign an agreement to withdraw your rights to the property with terms that they will pay you 10% in 45 days, you'll be lucky to get anything from these crooks. They even still owe all the ex-employees who lied through the teeth for them.

If anyone is in Dubai, my advice is to inform the DLD what they are doing and if you are happy with the rubbish 10% ask them to meet you at either the Courts or in your lawyers office and exchange the agreements for cash or bankers draft.

Ferial & Aliyah are not to be trusted!!!

Anonymous said...

Hi, we met Férial and as you said she is offering 10% as final settlement of the amount transferred by Escrow. She has a list of the investors and the amounts deposited by each one in Escrow and she is calling all the investors to make them this offer. According to her this list was provided by the court and has been audited by the court auditor. As you said if you agree, you have to sign a settlement agreement. We have decided to wait and see what comes from the court by way of a liquidation of the project as I believe there was a land purchased for the project which can be sold or auctioned. According to her only 10% is left in the escrow as funds were used to pay consultants and staff salaries. Will wait for Dec 20 hearing before the court.

Anonymous said...

There is no way the court will give Ferial a list of the customers, they have kept customer details from 10 years ago. Which lawyer are they using in Dubai?

Anonymous said...

Where did you meet with Ferial? is it in Dubai courts or her office?

Anonymous said...

Met Ferial in Dubai. She has taken an office at Dubai silicon oasis

Anonymous said...

Have you asked why they didn't build the projects the first place? and why are they looking to make a settlement after 10 years & WHAT DID THEY DO WITH THE MONEY WE PAID?

Anonymous said...

I believe better to wait the court's decision.

Dear all!

I would like to ask your kind assistance in solving my problem with Alzahra Real Estate Brokers.
In 8 Аpril 2008 I, investor from Moscow, Russia ( Ms Madina ) concluded an Agreement with the above mentioned company regarding reservation of the apartment at Jumeirah, Village South, Sunset Gardens А (unit 329).
In accordance with the agreement by 8th of April i have paid 70% of the reservation cost to the seller – Alzahra Real Estate Brokers which was represented by Mr. Yusuf Maki (address:PO Box 112800 Dubai, UAE).
The construction has not started yet;
I have no information regarding this matter whatsoever. Nobody is answering any of my questions. The office of Alzahra Real Estate Brokers is closed, they don’t answer any phone calls, their website is closed.
I don’t know where is Alzahra Real Estate Brokers.
Project Master developer Nakheel advises to contact Alzahra Real Estate.
The rera website states that the project is cancelled. I want to return the money which have been paid and located on the Escrow Account, as liabilities and conditions have not been fulfilled under the contract have been violated, and I am asking to inform me on update regarding this matter.

Kind regards
